Terms of Use

By accessing or using StorePulse, you agree to these Terms of Use (Terms). If you use StorePulse for an organisation, you confirm that you are authorised to do so and to provide the information you submit on its behalf.

A separate written agreement between Fashionata Pty Ltd (Fashionata, we, us, or our) and your organisation may also apply. That agreement prevails to the extent of an inconsistency about the organisation's purchase or use of StorePulse. These Terms apply to your individual access and conduct.

• You must provide accurate account information and keep it reasonably current.
• You must protect your sign-in methods and must not share an account or allow another person to act under your identity.
• You must promptly tell your organisation administrator or us if you suspect unauthorised access.
• Your organisation controls your membership, role, brand assignments, and access to its StorePulse account. It may change or remove that access.
• You must be legally able to accept these Terms or use StorePulse under the authority and supervision of your organisation.

StorePulse may be used only for legitimate visual merchandising and related field operations authorised by your organisation. You must follow applicable laws, workplace policies, retailer or site rules, and reasonable instructions from your organisation.

You must not:

• access data, brands, reports, or organisations you are not authorised to access;
• misrepresent your identity, attendance, location, work, or checklist results;
• upload unlawful, harmful, misleading, infringing, malicious, or unnecessarily sensitive content;
• photograph people, confidential materials, payment information, or restricted areas without appropriate authority;
• probe, bypass, disable, or interfere with security, access controls, service operation, or another user's account;
• introduce malware, scrape the service, or use automated access we have not approved;
• reverse engineer or copy StorePulse except where the law expressly permits it; or
• use StorePulse in a way that could damage us, another user, or a third party.

StorePulse records visit times, checklist activity, notes, images, and precise check-in location. The current workflow requires browser location permission and a captured latitude and longitude to begin a visit. Location accuracy and calculated distance depend on the device, browser, network, store coordinates, and surrounding conditions and may be incomplete or inaccurate.

You are responsible for submitting truthful records and for having permission to capture and upload workplace information. StorePulse records support operational review; they are not, by themselves, definitive evidence of attendance, hours, payroll entitlement, workplace safety compliance, or legal compliance. Your organisation remains responsible for employment, contractor, payroll, safety, and compliance decisions.

As between Fashionata and the relevant organisation, that organisation retains its rights in information and materials submitted to its StorePulse account (Organisation Content). You retain any rights you personally hold in content you are authorised to submit.

You and your organisation grant us a non-exclusive, worldwide right to host, copy, process, transmit, display, and otherwise use Organisation Content only as reasonably needed to provide, secure, support, and improve StorePulse, comply with law, and exercise our rights under these Terms. You confirm that you have the rights and permissions needed for the content you submit.

Our Privacy Policy explains how we handle personal information. You must respect the privacy and confidentiality of information available through StorePulse and use it only for your authorised work. Role and organisation access controls do not give you permission to disclose information outside its intended business purpose.

Fashionata and its licensors own StorePulse, including its software, design, branding, documentation, and other materials excluding Organisation Content. Subject to these Terms, we give you a limited, non-exclusive, non-transferable, revocable right to use StorePulse for your authorised work while your account remains active.

Feedback you voluntarily provide may be used by us without restriction or payment, provided we do not identify you publicly without permission.

StorePulse depends on managed services for authentication, hosting, database and file storage, and transactional email. Those services may experience outages, maintenance, or changes outside our control. We may also update, suspend, or discontinue features to maintain security, comply with law, or improve the service.

We aim to provide a reliable service but do not promise uninterrupted, error-free, or permanently available operation. You and your organisation should maintain appropriate operational contingencies and should not use StorePulse as an emergency communication or safety-response system.

We or your organisation may suspend or remove your access. We may act immediately where reasonably necessary to address suspected misuse, security risk, legal requirements, non-payment under an applicable organisation agreement, or harm to StorePulse or others. Provisions that by their nature should continue after access ends—including ownership, confidentiality, disclaimers, liability limits, and governing law—will continue.

Nothing in these Terms excludes, restricts, or modifies a right, guarantee, condition, warranty, or remedy that cannot lawfully be excluded, including under the Australian Consumer Law where it applies.

Subject to those non-excludable rights, StorePulse is provided on an “as available” basis. We do not warrant that information entered by users is accurate or complete, that location readings will prove physical presence, or that the service will meet every organisation's operational, employment, payroll, safety, or compliance requirements.

To the maximum extent permitted by law, Fashionata is not liable for indirect, consequential, special, or punitive loss, loss of profit or opportunity, loss or corruption of data, or loss caused by unauthorised use, user-submitted information, or a third-party service outage.

Where we are permitted to limit a remedy for breach of a non-excludable guarantee relating to services, our liability is limited, at our option, to supplying the services again or paying the reasonable cost of having them supplied again. This section does not limit liability where doing so would be unlawful.

We may update these Terms to reflect changes to StorePulse, our operations, or legal requirements. The current version will be published here with its effective and last-updated dates. If a change is material, we will take reasonable steps to give additional notice. Continued use after the updated Terms take effect constitutes acceptance to the extent permitted by law.

These Terms are governed by the laws of New South Wales, Australia. The courts of New South Wales and courts entitled to hear appeals from them have non-exclusive jurisdiction.
